APPEALS

**Please note that the Freedom of Information Act (FOIA) and Privacy Act (PA) appeal process is not intended for individuals to appeal their denial of employment, security clearance and/or access privileges. If you have any questions concerning your eligibility for employment and/or security clearance issues, please contact your facility security officer and/or hiring/employment agency.

DENIAL OF INFORMATION:

The withholding of information from INSCOM records requested under the FOIA and/or PA may be appealed to the Secretary of the Army, through the INSCOM FOIA Office. Appeals should be postmarked no later than 60 calendar days from the date of the letter wherein the denial of information was documented and the rationale for release of the withheld information should be provided.

**Please note that you can only appeal information that was withheld from the requested document(s).

NO RECORDS:

In the event no records were located in response to a FOIA and/or PA request, the no record response may be appealed. The appeal should state the basis for an additional search to be conducted along with any additional information which would leave us to believe INSCOM records exist.

**Please note INSCOM is authorized to act on FOIA/PA requests regarding intelligence and security records, foreign scientific and technological records, intelligence training, intelligence threat assessments, and foreign liaison information, mapping and geodesy information, ground surveillance records, intelligence threat assessment, and missile intelligence data relating to tactical land warfare systems.

Individuals may also appeal the denial of a request for a fee waiver, denial of expedited processing or non-responsiveness to a request.

Appeals regarding any of the above instances should be forwarded to the:
